Álom legal

Terms of Service

Last updated 9 October 2026

These terms apply to every quote, project and service from Álom, and to your use of this website. Please read them before you accept a quote or pay an invoice.

In short
  • You agree to these terms when you accept a quote, pay an invoice or let us start work.
  • We do not give refunds. See the Refund Policy. Your rights under the Australian Consumer Law are not affected.
  • You own your final website once it is paid for. We keep the copyright in photography and video and give you a licence to use it.
  • We cannot promise rankings, traffic or AI search results.
  • The laws of Western Australia apply.

1. About these terms

Álom is a trading name of Kia Bako-Kirkpatrick, a sole trader based in Inglewood, Western Australia (ABN 46 198 970 748). In these documents, “Álom”, “we”, “us” and “our” mean that business.

These terms apply when you accept a quote in writing (including by email or message), pay an invoice, or ask us to start work. If you and Álom sign a separate written agreement that conflicts with these terms, the signed agreement applies to the extent of the conflict.

2. Our services

We provide web design and development, SEO and AI search work, digital marketing, photography and videography, as described in your quote. We only provide the services listed in your quote.

3. Quotes and scope

  • Prices are in Australian dollars and include GST unless the quote says otherwise.
  • A quote is valid for 30 days unless it says otherwise.
  • Work outside the quoted scope, or extra revision rounds beyond those in the quote, is quoted separately and agreed with you before we start it.
  • The quote describes what we deliver. If something is not in the quote, it is not included.

4. Payment

  • We may ask for a deposit before work starts or a shoot date is held. The deposit is not refundable (see the Refund Policy).
  • Pay each invoice by the due date on it. If no date is shown, payment is due within 14 days.
  • Ongoing services are invoiced in advance for each month.
  • If an invoice is overdue, we may pause work, hold back final files until you have paid in full, and recover the debt. You pay the reasonable costs of recovery to the extent the law allows.
  • GST is added where it applies and shown on your invoice.

5. What we need from you

  • Give us the information, content, access and feedback we ask for, on time. Delays on your side move the timeline.
  • Make sure what you supply is accurate and that you have the right to use it, including text, logos, images and music.
  • For shoots, arrange access to the venue and any permission needed from the venue, and tell the people being photographed or filmed. You are responsible for getting any consents needed from them, including from parents or guardians for children.
  • If your industry has advertising or content rules (for example health practitioners, finance or legal), you are responsible for making sure your content meets them. We will follow reasonable instructions to help you do that.

6. Timelines

Dates we give you are estimates unless we agree in writing that they are fixed. We are not responsible for delays caused by things outside our control, such as illness, weather, power or internet failures, or third party outages.

7. Intellectual property

Photography and video. We own the copyright in the photos and videos we create, as the Copyright Act 1968 (Cth) provides. Once you have paid in full, we give you a non exclusive licence to use the final delivered images and video for your own business, including your website, social media, print and advertising. You must not sell or licence them to others, use them for another business, or use them to train artificial intelligence systems. We do not supply unedited or raw files unless the quote says so.

Websites and written work. Once you have paid in full, you own the custom design and the copy we wrote for you. Third party items, such as themes, plugins, fonts, stock images and hosting, stay under their own licences, and you may need to pay for those licences and renewals. We keep our general know how, tools and reusable code. Your domain name is registered in your name.

Your materials. You keep ownership of the materials you give us and you allow us to use them to do the work.

Portfolio. We may show completed work in our portfolio, case studies and social media. If you do not want us to, tell us in writing before the work starts. Where practical, please credit Álom when you publish our photography.

8. SEO, AI search and marketing

We use reasonable skill and care, but we cannot promise any particular ranking, traffic, enquiries or mention in AI assistants such as ChatGPT, Gemini, Perplexity or Claude. Results depend on competitors, search engine and AI company decisions and many other things we do not control. Advertising spend is paid by you directly to the platform.

9. Third party services

Websites depend on third parties such as domain registrars, hosts, plugins and platforms. We are not responsible for their outages, changes or fees, and you must follow their terms.

10. Cancellations and refunds

Cancellation, rescheduling and refunds are covered in the Refund Policy, which forms part of these terms.

11. Confidentiality

We keep your non public business information confidential and use it only to do the work. We may share it with subcontractors who are bound to confidentiality, or where the law requires. We remain responsible for work done by our subcontractors.

12. Our service guarantee and the Australian Consumer Law

We provide our services with due care and skill. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth), applied in Western Australia by the Fair Trading Act 2010 (WA)) that cannot lawfully be excluded.

Where the law allows us to limit our liability for failing to meet a consumer guarantee, and the services are not ordinarily acquired for personal, domestic or household use, our liability is limited to supplying the services again or paying the cost of having them supplied again.

13. Limit of liability

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, revenue, data, goodwill or opportunity. Our total liability for any claim relating to a service is limited to the amount you paid us for that service. Nothing in these terms limits liability that cannot be limited by law.

14. Your responsibility for what you supply

You are responsible for claims that arise because materials you supplied infringe someone’s rights, or because you did not get a permission or consent you were required to get. You will cover our reasonable losses from those claims.

15. Using this website

The information on this website is general and is not advice. Please do not copy, scrape or republish our content for commercial use without our written permission, and do not try to interfere with the site or its security. See the Legal page for more.

16. Ending an agreement

Ongoing services can be ended by either of us with 30 days’ written notice. We may end an agreement immediately if you do not pay or you seriously breach these terms. Ending an agreement does not affect amounts owed, intellectual property, confidentiality or limits on liability.

17. Disputes

If there is a problem, please tell us first by email. We will try to sort it out in good faith within 30 days. If we cannot, either of us may take the next step the law allows. You can also contact Consumer Protection, Department of Mines, Industry Regulation and Safety (Western Australia).

18. Governing law

These terms are governed by the laws of Western Australia. Each of us submits to the non exclusive jurisdiction of the courts of Western Australia and the courts that hear appeals from them.

19. General

  • We may update these terms. The version in force when you accepted your quote applies to that project, and the current version applies to the website.
  • If any part of these terms is unenforceable, the rest still applies.
  • If we do not enforce a right straight away, we have not given it up.
  • You cannot transfer your rights under these terms without our written consent.
  • We can give notices by email to the address you gave us.
